MES DELEGACIONIT FRANCEZ (OFPRA)  DHE INSTITUTIT “SHTEPIA E DREJTESISE DHE PAJTIMIT KOMBETAR” I.SH.D.P.K

  Panoramë e pergjithëshme mbi punën dhe aktivitetin e I.SH.D.P.K.

• Prezantim i përgjithshëm i organizates  per  punën brënda dhe jashtë Shqipërisë . Prej sa vitesh operon si Institut, format e operimit, si merret në trajtim një çeshtje per ndermjetesim , hapat që ndiqen në zgjidhjen e saj, nga plotësimi i formularit te kerkeses se  ndermjetesimit deri  ne zgjidhjen e këti konflikti.

Fenomeni i gjakmarrjes dhe kërkesat për Azilit:

 

• Eshte biseduar rreth fenomenit të gjakmarrjes, çfarë është ky fenomen, cilat janë arsyet që dërgojnë familjet drejt aktit të gjakmarrjes, si mundësohet realizimi i negocjimit dhe pajtimit (“Faljes së gjakut”) mes familjeve?

 

Pyetjet që u shtruan në këtë takim:

 

°         Si arrihet proçesi i ndërmjëtësimit?

°         Kur arrihet proçesi i pajtimi, shoqërohet me ndonjë ceromoni e veçantë?

°         Kur nuk arrihet pajtimi mes palëve vazhohet të punohet mbi rastet apo ndërpritet puna?

°         Është më e lehtë të pajtosh në ditët e sotme apo ishte me e lehtë në kohët e shkuara?

°         Shoh që në stafin tuaj bëjnë pjesë të rinj dhe gjinia femërore, bëjnë pjesë të institutit pasi janë pjesë e ndërmjetësuesve / negociuesve që negociojnë me keto mosha dhe gjini?

Pergjigje nga drejtuesi I I.SH.D.P.K dhe koordinatoret dhe keshilltari ligjor.

1.-Procesi i pajtimit fillon ne baze te kerkeses qe behet prane selise, degeve ne rrethe duke bere kerkesen e ndermjetesimin bashke me nje dokument indetifikimi , pas kesaj kerkese fillon puna per ndremjetesim.

2.- Kur arrihet pajtimi  behet nje cermoni e vacate mes dy familjeve, ne fillim misionaret bashke me familjen qe ka vrare, shkon tek familja e demtuar dhe kerkon falje dhe shtrihet dora e pajtimit duke pire kafen e pajtimit.

Me pas familja e demtuar se bashku me misionaret shkojne per te kthyer viziten familjes e cila kerkoi faljen dhe perseri shtrihet dora e pajtimit dhe  shtrohet  per te ngrene buken e pajtimit, sipas zakonit  kjo cermoni shoqerohet dhe me lot ne sy nga te pranishmit nga te dy palet, emocione te forta perjtojne dhe misinaret dhe drejtuesi i organizates i cili merr pjese ne cdo pajtim.

3.-Kur  nuk arrihet pajtimi mes paleve merren masa per te larguar familjen nga nje rreth ne nje rreth tjeter te vendit,  per te shmangur konfliktin dhe vrasjen. Puna vazhdon deri sa merret nje pergjigje perfundimtare qe pala e demtuar nuk pranon te pajtohet, ka raste qe familjet qe ju rrezikohet jeta largohen jashte Shqiperise duke ju larguar konfliktit dhe mundesise qe pala e demtuar te mos hakmerret.

4- Te pajtosh ne ditet e sotme eshte shume me e veshtire se sa ne ditet e shkuara se atehere kur I pari fisit thoshte se do falet gjaku askush nuk diskutonte me, kurse sot teper e veshtire me i vogli i familjes po nuk u bind dhe ai, procesi i pajtimit dhe pajtimit nuk realizohet, dhe nje here dua te theksoj se eshte shume me e veshtire sot se ne kohet e dikurshme.

5- Eshte vertete  se ne organizaten qe drejtoj ka shume te rinj dhe te reja, keta jane pjese e ketij Instituti qe kane premisa me shume per falje. Sic e shikoni kemi dhe te moshes se vjeter, te cilet jane burra te mencur dhe fjala e tyre ze vend ne cdo familje.

Atehere te rinjt dhe rejat bejne punen me te rinjt te te reja e familjeve te demtuara, qe do te thote mosha me moshen bisedojne dhe mentaliteti i moshes se vjeter  kerkon moshen vjeter, mentaliti i moshes se re kerkon moshen e re.

Tjetër:Vënë në dispozicion palës Franceze dokumentacione në lidhje me fenomenin e gjakmarrjes: Kopje të formularit të aplikimit,Kerkese Ndermjetesimi,  Akt – Pajtimi, listat e pesonave (familjeve) që janë në konflikt, lista e personave (familjeve) që janë pajtuar,.

Eshte vene ne dispozicion , përfaqësuesve të (OFPRA ) nje  kopje dokumentash (vula, firma) të fallsifikuara  nga fallsifikatoret. Fallsifikatori eshte  arrestuar nga policia e shtetit pasi fallsifikonte formulare  nen emrin e I.SH.D.P.K-se për të përfituar azil në shtetet Europiane.

Per kete problem  te fallsifikimit te dokumentave dhe vulvae te institutit te ISHDPK-se  eshte informuar opinioni publik, kombetar dhe nderkombetar ne permjet zyrave perkatese dhe faqes se zyrtare ne internet te ISHDPK-se  .

PJESEMARRESIT:Ne kete takim ishin te pranishem koordinatoret e Qarkut Shkoder, Lezhe,Durres,Tirane,se dhe keshilltar juridik, punonjes sociale dhe psikologe. qe operojne ne terren.

REPORT ON THE MEETING IN SHKODRA

BETWEEN THE FRENCH DELEGATION (OFPRA) AND  “HOUSE OF JUSTICE AND NATIONAL RECONCILIATION” INSTITUTE,  I.SH.D.P.K.

Participants: 18 total representatives (OFPRA) – French Office for the Protection of Refugees and Stateless Persons, meeting with staff I.SH.D.P.K – Institute “House of Justice and National Reconciliation”

Venue: Hotel-restrorant tradition, Shkoder

Subject: Blood Feud

Issues reviewed:

• General Overview of the work and activities of I.SH.DPK

°         General presentation for the work of organization inside and outside Albania. How many years is the institute operateing, forms of operation, how is taken the treatment for intermediation, the steps followed in solving it from filling of  the form to the resolution of this conflict.

• The phenomenon of blood feud and requests for asylum:

O We have talked about blood feud, what is this phenomenon, the reasons that lead families to the act of vendetta, and enable the realization of the negotiation of reconciliation (“Forgiveness of Blood”) between families?

Questions raised at the meeting:

 How is the process of intermediation?

 When reached reconciliation process, accompanied by a special ceromoni?

 When the parties do not agree to work on cases, do you try again or stop?

 It is easier to reconcile today or easy was in days gone by?

 We see that your staff are part of young and female gender, are part of the institute as part of mediators / negotiators to negotiate with these age and gender?

The response from the director, coordinators of I.SH.DPK and legal advisor.

1.-The process of reconciliation begins on time that the request was made at headquarters, branches in the districts making mediation request together with a document identification, then this request for inermediation work begins.

2. – When reconciliation is done, we do a ceremony between the families. Early missionaries along with the family that has killed, goes to apologize and extend the hand of reconciliation and drinking coffee of reconciliation.

Then the injured family along with returning missionaries go to visit family which again asked forgiveness and reconciliation and a hand raised to forgive, they eat the bread of reconciliation, according to custom it cermony associated with tears of the participants from both parties, strong emotions for missionaries of the organization too, which takes part in every line.

3.-If no agreement is reached between the parties take measures to remove the family from one to another around the country, to avoid conflict and killing. Work continues until the deal a final response to the injured party refuses to comply, there are times that families leave the country of Albania  to avoiding conflict and the possibility that the injured party not to retaliate.

4 – To reconcile today is much more difficult than in the past years when the first  tribe say that this blood will be forgiven and it is done. Today the first tribe is missing his attributes and is very difficult to convice the young people to forgive and the process of reconciliation is very difficult.  I am repeating again, that it is much more difficult today than in times before.

5 – It is true that the organization that has lead many young and new, these are part of this Institute premises that have more chances to bring families to apologize. As we see we have old age too, who are the wise men, and their word takes place in every household.

Then the youth make updates to work with the youth of the affected families, which means talking age to the age. The old age mentality requires old age persons to work with them.

Others: Putting the French party documentation available about the phenomenon of Blood Feud: Copies of the application form, Mediation Request, Act – Reconciliation lists  (families) who are in conflict, the list of persons (families) who have agreed.

It is made available, representatives (OFPRA) a copy of documents (stamp, signature) forged by counterfeiters. Counterfeiters  was arrested by state police after falsifying forms under I.SH.DPK’s name, to gain asylum in European countries.

For this problem to forging documents and stamps of the ISHDPK-informed public opinion, nationally and internationally through abusive respective offices and official web-site of the ISHDPK .

• PARTICIPANTS: In this meeting was attended by coordinators of Shkodra, Lezha, Durres, Tirana, and the legal adviser, social worker and psychologist operating in the field.

OTHER: Rendered availability for a possible cooperation between the parties, in documentation, logistics, availability to verify that the issues presented are true to be presented for research Asylum
